These Terms of Service (“Terms”) govern your use of the Sysplained website at sysplained.com (the “Website”) and the Sysplained desktop application (the “Software”), provided as a private, non-commercial project (“we”, “us”, “our”). The operator is identified in the Imprint.
By accessing the Website or downloading the Software, you agree to these Terms.
1. License to Use the Software
The Sysplained desktop application is provided free of charge for personal and commercial use. The Software is proprietary and all rights are reserved unless otherwise stated.
You may:
- Download and install the Software on macOS devices you own or control
- Use the Software for personal or professional purposes
You may not:
- Reverse engineer, decompile, or disassemble the Software
- Redistribute, sublicense, or sell the Software
- Remove or alter any proprietary notices or labels
2. Intellectual Property
The Sysplained name, logo, and associated branding are protected. You may not use these marks without prior written permission, except for purposes of referring to or linking to the Software or Website.
3. Disclaimer of Warranties
THE SOFTWARE AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Software will be error-free or uninterrupted
- The Software will meet your specific requirements
- The results obtained from use of the Software will be accurate or reliable
- Defects in the Software will be corrected
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE OR WEBSITE.
Our total liability for any claim arising under these Terms shall not exceed the amount you have paid for the Software (which is $0 for the free version).
5. System Access and Permissions
The Software executes macOS system commands (such as ifconfig, netstat, lsof, arp, dig, and others) to gather network and system information. By using the Software, you acknowledge that:
- The Software requires permission to execute these system commands
- The Software operates under a strict capability allowlist
- No arbitrary shell commands can be executed through the Software
- All data processing occurs locally on your device
6. Updates
We may release updates to the Software from time to time. We are under no obligation to provide updates, support, or maintenance.
7. Termination
You may stop using the Software at any time by uninstalling it from your device. We reserve the right to modify, suspend, or discontinue the Software or Website at any time without notice.
8. Governing Law
These Terms are governed by the laws of Switzerland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Switzerland.
9. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Software or Website after changes constitutes acceptance of the updated Terms.
